Terms of Use

1. Acceptance of Terms
By accessing kelseybartley.com or engaging our services, you agree to be bound by these Terms of Use. If you do not agree, please do not use the site or our services.
2. Services Provided
We offer custom AI builds (including Claude skills, custom GPTs, automated workflows, and assessment and scoring tools), advisory engagements (including workflow audits and builds, strategy advisory, training, and speaking), copywriting, and digital products. We reserve the right to modify, add, or discontinue offerings at any time.
3. Eligibility and Account Access
You must be at least 18 years old to use our services. If you create an account or receive access credentials, you are responsible for maintaining their confidentiality and for activity under your access.
4. Payment Terms
Fees are quoted and payable in U.S. dollars. Digital products are paid in full in advance and processed through third-party providers (including Gumroad and its payment processors). Custom builds and advisory engagements are governed by the scope, fee, and payment schedule set out in the individual engagement agreement. Any recurring or subscription charges renew automatically until cancelled by you.
5. Engagement and Product Terms
Access to services and digital products is personal and non-transferable. For custom builds and advisory engagements, deliverables, timeline, and scope are defined in writing before work begins and do not change without mutual agreement. Cancellation of a recurring service stops future billing; see Section 11 regarding refunds.
6. Acceptable Use and Conduct
You agree to use the site and our services lawfully and respectfully. Harassment, discrimination, infringement, and any unlawful or abusive conduct are prohibited and may result in suspension or termination of access.
7. Responsibilities and Provisions
We provide our services with reasonable care and quality. The outcomes you achieve depend on your own effort, decisions, systems, and circumstances. Active participation and timely input from you are necessary for the work to succeed.
8. Intellectual Property
All content on this site and within our services, including text, frameworks, methodologies, and materials, is protected and remains our property or that of our licensors. You receive only a limited license for your own internal or personal use, unless otherwise agreed in writing.
9. License for Digital Products and Builds
Digital products and delivered builds are licensed for the purchaser's own use (or, where agreed, the purchaser's client use under a white-label arrangement). Redistribution, resale, or sharing outside the agreed license is prohibited. Specific license terms for a build are set out in its engagement agreement.
10. Testimonials, Feedback, and Publicity
Feedback, testimonials, and similar content you provide may be used in our marketing. You may withdraw consent for future use by contacting us at kelsey@kelseybartley.com.
11. Refunds
Digital products are final and non-refundable once purchased. Custom builds and advisory engagements are governed by the refund and cancellation terms in their individual engagement agreement. Where no such term applies, fees paid are non-refundable.
12. No Guarantees or Warranties
Our content and services are provided “as is.” We make no guarantee of specific results, revenue, time savings, or other outcomes. We do not provide legal, financial, tax, medical, or accounting advice.
13. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from the site, a product, or a service is limited to the amount you paid for that specific product or service.
14. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, and expenses arising from your use of the site or services or your violation of these Terms.
15. Force Majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Tennessee. Any dispute will be resolved in the state or federal courts located in Knox County, Tennessee.
17. Modifications
We may update these Terms at any time by posting the revised version on this page. Continued use of the site or services after changes are posted constitutes acceptance.
18. Severability and Entire Agreement
If any provision of these Terms is found invalid, the remaining provisions stay in effect. These Terms, together with any applicable engagement agreement, constitute the entire agreement between you and us.
